Q - As a naturopath I use biofeedback in my business. Should I be a BANA or TNTANA member?

A - You will receive the broadest coverage by declaring yourself a naturopath who includes biofeedback within your practice and join TNTANA. If biofeedback is your primary business and you do a little naturopathy as part of that business, you do qualify as a dual professional member of BANA.

Q - I do a little homeopathy in my biofeedback business. Should I be a BANA or TNTANA member?

A - This is the same question in another modality as answered above. You will receive the broadest coverage by declaring yourself a homeopath who includes biofeedback within your practice and join TNTANA. If biofeedback is your primary business and you do a little homeopathy as part of that business, you do qualify as a dual professional member of BANA. If the only homeopathy you do is duplicating homeopathic remedies, you qualify as a dual professional member of BANA and that's your best option.

Q - What does malpractice insurance cover?

A - Malpractice insurance is intended to cover you for any unintentional harm you cause your client or any unintentional harm your client thinks you caused him or her. Malpractice insurance does not cover automobile, general, or homeowners liability. Malpractice insurance does not cover your illegal activity or harm you intentionally cause another person. General Liability and Professional Liability Benefit Plan

Q - What does general liability insurance cover?

A - General liability insurance is intended to cover you for negligent acts on your part when your automobile, homeowners or professional liability insurance does not cover your negligence. You are not covered by general liability insurance if other people are harmed by your automobile, home property or a professional act by you. Q - Sometimes I give nutritional advice. Should I list nutrition as something I do as part of my profession?

A - This is a decision you need to make. If you have no training in nutrition and are not certified or licensed in a profession that provides nutritional counseling, you will not be covered by any professional insurance policy we've been able to find. You need to decide how much risk you're willing to take if you're not certified or licensed in a profession that provides nutritional counseling. Professional (malpractice) insurance will not cover you unless you are licensed or certified in a profession that includes nutrition within the scope of practice for that profession.

If you give any nutritional advice, suggestions or recommendations you are counseling your client. In most states and provinces you are legally required to have a license to do this. If you are trained in basic coaching skills, you may legally practice nutritional coaching in these jurisdictions. But you need to make very sure you are coaching and not counseling or selling.

If you are certified or licensed in nutrition or in a profession that includes nutrition within the scope of practice for that profession, you just need to decide if you should carry professional liability insurance or not. Since the public is unpredictable in a financial crisis, we believe professional liability insurance is a good investment in your financial future.

If you are not certified or licensed in nutrition or in a profession that includes nutrition in your scope of practice, we suggest you make arrangements with another professional to discuss nutrition with your clients. If you're in a MLM nutritional supplement business, we suggest you use a member of your downline and refer your clients to that person. Make full disclosure of your relationship to be on the safe side.

Q - I'm certified in nutrition and licensed as a naturopath. What insurance do I need? Sometimes I also do a little reflexology. Do I need insurance for that too?

A - If you decide to protect yourself against professional malpractice claims, join TNTANA as a Professional Member listing both nutrition and naturopathy as your profession. You may also list any other profession you practice for no additional membership fee. That includes reflexology. It just makes sense to list everything you practice so you have the best coverage money can buy.

Q - I don't use an informed consent form because I'm licensed as a spiritual healer. I also do some nutritional counseling. Which classification do I use for joining TNTANA.

A - You don't qualify for TNTANA membership for these reasons: 1) Spiritual healer licenses through boards accredited by the Federation of Spiritual Healer Licensing Boards (FSHLB) require the use of an informed consent form, 2) The insurance benefits offered by TNTANA also require the use of an informed consent form, and 3) The insurance benefits offered by TNTANA cover nutritional coaching but do not cover nutritional counseling.

If you are licensed by an FSHLB accredited spiritual healer licensing board, you can join TNTANA as a spiritual healer and spiritual nutrition services would be fully covered. Any other nutrition services you provide would not be covered unless you otherwise qualify for this coverage.
